GENERAL TERMS AND CONDITIONS OF SALE

1. Purpose


These General Terms and Conditions of Sale (GTCS) define the terms of reservation, payment, and participation in sea excursions offered by MANUTEA CHARTERS SAS (hereinafter referred to as “the Provider”).
Any reservation implies full and unconditional acceptance of these GTCS.


2. Services Provided


The Provider organizes full-day sea excursions including:

  • Navigation aboard the vessel,
  • A professional crew,
  • Activities included in the program (snorkeling, anchoring, beach stops, etc.),
  • Possibly beverages, meals, or equipment (depending on the selected offer).
  • A detailed description of each excursion is available on the Provider’s communication materials.


3. Reservation


A reservation is considered confirmed when:

  • The client has provided complete and accurate information,
  • The Provider has confirmed availability,
  • A deposit of 20% or the full amount has been paid.
  • If the deposit is not received within 48 hours, the reservation will be automatically canceled.


4. Prices


Prices are expressed in US dollars and include all applicable taxes unless otherwise stated.
Prices include only the services specifically mentioned in the description.
Any additional option (meals, specific activities, transfers, etc.) will be subject to an additional charge.


5. Payment Terms


Payment may be made by:

  • Credit card,
  • Bank transfer,
  • Cash (within local legal limits).

The balance must be paid no later than the day of departure or according to the terms specified at the time of booking.


6. Cancellation by the Client


Any cancellation must be notified in writing (email or dated message).
Cancellation fees are as follows:

  • Free cancellation up to 48 hours before departure,
  • No-show (failure to appear on the day of departure): no refund.

No refund will be granted for reasons related to:

  • Client’s delay,
  • Missing or forgotten documents,
  • Poor assessment of personal comfort, health, or sea conditions tolerance.


7. Cancellation or Modification by the Provider

The Provider reserves the right to cancel or reschedule the excursion in the event of:

  • Dangerous weather conditions,
  • Technical issues with the vessel,
  • Unforeseen crew unavailability,
  • Safety-related reasons.

In such cases, the client may choose between:

  • Rescheduling the excursion, or A full refund.
  • No additional compensation may be claimed.


8. Safety, Health, and Client Obligations

Clients agree to comply with:

  • Safety instructions given by the crew (the captain is the sole authority on board and must be obeyed),
  • Proper use of equipment,
  • Applicable maritime regulations.
  • The captain may refuse boarding to any person:
  • Under the influence of alcohol,
  • Under the influence of illegal substances,
  • Displaying dangerous behavior,
  • Whose physical condition is deemed incompatible with the excursion.
  • No refund will be granted in such cases.


9. Children and Minors


Minors must be accompanied by a responsible adult.
Parents or legal guardians are fully responsible for the safety of minors on board.


10. Health and Physical Limitations


Clients must inform the Provider of any medical condition that may affect participation (allergies, pregnancy, heart conditions, reduced mobility, etc.).
Certain activities (snorkeling, swimming) may be discouraged.
The Provider reserves the right to refuse participation if it represents a risk.


11. Liability


Swimming and water activities (snorkeling, paddleboarding, etc.) are carried out under the sole responsibility of the passengers.

The crew does not supervise swimming activities.
Each passenger is responsible for their ability to swim and for supervising minors.

The captain may cancel or shorten swimming activities for safety reasons.

The Provider is responsible for the proper execution of the excursion within the limits of an obligation of means.
The Provider shall not be held liable for:

  • Lost, damaged, or stolen personal belongings,
  • Injuries resulting from failure to follow safety instructions,
  • External events (marine wildlife, sudden weather changes, sea conditions).
  • The Provider declines all responsibility for loss, theft, or damage to personal belongings.
    In the event of damage caused by failure to follow safety instructions, liability rests with the passenger.
  • In the event of a dispute, the Provider’s total liability is limited to the amount paid for the excursion concerned.


12. Insurance


The Provider holds the mandatory professional insurance required for maritime passenger transport.
Clients remain responsible for their personal belongings and may take out additional insurance (cancellation, health, luggage).


13. Use of Images

Clients agree that photos and videos taken during the excursion may be used for promotional purposes unless written objection is provided in advance.


14. Personal Data


The information collected is necessary for processing reservations.
It will not be shared with third parties without consent.


15. Applicable Law and Disputes

These GTCS are governed by the laws applicable in Saint-Martin (French part).
In the event of a dispute, an amicable solution will be sought as a priority.
Failing this, the competent courts shall be those of the Provider’s registered office.


16. Acceptance of the Terms

Booking a sea excursion constitutes full and unconditional acceptance of these General Terms and Conditions.
